Everest Effect, Inc. (hereinafter referred to as “Everest,” “we,” “our,” or “us,” as the context provides) is committed to respecting your privacy.  This Privacy Statement describes how we collect, use, disclose, store, and otherwise process information through our Services.

Any capitalized terms used in this Privacy Statement and not otherwise defined herein have the meaning given in our Terms of Service.

  1. Scope

This Privacy Statement covers data collected through our Site, your Everest ID, and any of our related Services, including any service where a direct link to this Privacy Statement is provided.  

Each Service Provider that you visit and/or receive goods and/or services from has their own data collection practices which are governed by their own privacy policy which may be different from the terms in this Privacy Statement.

  1. Types of Data and Collection Methods

“Personal information” means information that identifies you or allows you to be contacted (your email address).  The personal information that we may collect about you broadly falls into the following categories:

You voluntarily provide us with certain personal information voluntarily when you register for an Everest ID with a Service Provider.  This may include your name, telephone number, address, email address, and certain biological information, such as any allergies you may have.

When you visit our Site, we may collect certain information automatically from your device.  Specifically, the information we collect automatically may include information such as your IP address, device type (e.g., computer, smart phone, or tablet), unique device identification numbers, browser-type, broad geographical location (e.g., country or city-level location), and other technical information.  We may also collect information about how your device interacted with our Site, including the pages accessed and the links clicked, if any.  

Collecting this information helps us to better understand the visitors to our Site, where they are located, and what content on our Site interests them (or not).  We use this information for our internal analytical purposes and to improve the quality of our Site for our visitors.

Some of this information may be collected using cookies or similar tracking technology, as explained further in section 12.  Our Cookie Statement.

We receive personal information about you from third-party Service Providers (social care service providers that you visit or receive goods or services from) if you have checked a box or otherwise consented to allow such Service Providers to upload or submit your personal information to your Everest ID, or where otherwise legally permitted or required required to disclose your personal information to us.  

The types of information we collect from these third-parties may include your name, contact information, and information regarding your visits to their facilities or acceptance of certain goods and services and we use this information to understand your overall needs and to provide you with a better experience with the social care economy.  

  1. Collection, Purpose, Use of Data

We collect personal information for the purposes of operating, maintaining, protecting and improving our Site, and our Services and to better understand the needs, interests, and preferences of individuals in need and to improve their experiences with the social care economy.

We do not currently, but in the future, we may also use your personal information to communicate with you via technical notices, updates, security alerts, and support and administrative messages so as to support our business functions, such as our support to you, fraud prevention, marketing, industry benchmarking and analysis consistent with our legitimate business purposes, and legal and/or regulatory functions.  To do this, we may combine personal and non-personal information, collected online and offline, and from third-party sources.

  1. Sharing and Disclosures of Personal Information

We do not rent or sell your personal information to others, but we may disclose your personal information with third-party Service Providers that work with us, and as described in this Privacy Statement.  For example, we may share your personal information as follows:

We may share your information with third party vendors, consultants and other service providers who provide information systems or who are working on our behalf and require access to your information to carry out that work, such as to provide customer support, quality assurance, etc. These service providers are authorized to use your personal information only to the extent necessary to assist us in providing our Services to you.

If you choose to receive goods or use the services of Service Providers within the social care economy, we may share information about you, including your username and/or email address with such Service Providers.  This Privacy Statement does not apply to your use of or interactions with any third-party Service Providers, and we are not responsible for how those Service Providers collect, use, and disclose your information. We encourage you to review the privacy policies of those Service Providers before connecting to or using their facilities or services to learn more about their information and privacy practices.  

We may be required to disclose personal information to authorities, law enforcement agencies, government agencies, or legal entities. We may disclose information by law, litigation, or as a matter of national security to: (a) comply with valid legal process, including subpoenas, court orders or search warrants, or as otherwise authorized or required by law; or (b) in the event of an emergency that threatens an individual’s life, health, or security.

We may share or transfer your information in connection with, or during negotiations of any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We may share aggregated or anonymized information that does not directly identify you with third-parties, including Service Providers.

  1. International Transfers

Your personal information may be transferred to, and processed in, countries other than the country in which you live.  These countries may have data protection laws that are different to the laws of your country.  Specifically, our Site and servers, and our affiliated companies and third-party service providers and partners may be located in the United States or may operate around the world. This means that when we collect your personal information, we may process it in any of these countries, provided that we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Statement.  If we transmit your personal information across national boundaries, we make reasonable efforts to do so in compliance with any national laws that govern the cross-border transfer of information.

  1. Data Retention

We retain personal information we collect from you where we have an ongoing legitimate business need to do so or to comply with applicable legal requirements.  When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (e.g., because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.  

  1. Data Security

Security of all information is of the utmost importance to us.  We use technical and physical safeguards, including industry-standard encryption technology, to protect the security of your personal information from unauthorized disclosure. We also take reasonable efforts to ensure that only authorized people and third-parties have access to personal information. Nonetheless, no service is completely secure and security measures cannot prevent all loss, misuse or alteration of personal information; we are not responsible for any damages or liabilities relating to any such incidents to the fullest extent permitted by law.  Where required by law, we will notify you of any such loss, misuse, or alteration of personal information that may affect you so that  you can take the appropriate actions for the protection of your rights.

  1. Changes to this Privacy Statement

We may change this Privacy Statement from time to time.  If we make any changes, we will notify you by revising the “Last Updated” date at the top of this Privacy Statement.  If there are material changes to this Privacy Statement, we will notify you more directly by email or means of a notice on the homepage of our Site prior to the change becoming effective.  We encourage you to review our Privacy Statement whenever you access or use our Services to stay informed about our information practices and the ways in which you can help protect your privacy.

If you disagree with any changes to this Privacy Statement and do not wish your information to be subject to the revised Privacy Statement, you will need to deactivate your Everest ID with the Service Providers and stop using this Site and our Services.  Your use of our Services after the posting of such changes will constitute your consent to such changes.

  1. Opt-Out; Notice to California Residents

Pursuant to California Civil Code Section 1798.83, California residents may request certain information regarding the types of personal information we share with third-parties for their direct marketing purposes.  However, Everest does not share personal information with third-parties for their direct marketing purposes and this law does not apply to us.  If you have any questions regarding our privacy practices, please contact us at the information provided in section 9. If you are a California resident, under the California Consumer Privacy Act (CCPA) you have the right to opt-out of the sale of your personal information. Everest does not rent, sell, or share your personal information with third-parties except to the extent you have requested us to do so (e.g., with Service Providers).  Thus, we are not required to word this section as “Do Not Sell My Personal Information” per the CCPA.  If you have any questions about our information practices or your rights under the CCPA, please contact us at the email address located in section 9.
